Matrimonial Investigations

The financial issues of family law property settlements can be significant and complex. We understand that family law matters are different to other dispute resolution matters.

Our services in respect to such matters include:

  • Critically reviewing information (especially financial) supplied by the other party.
  • Conducting a preliminary review of financial accounts and other information to ascertain if there is likely to be any applicable goodwill to trading businesses.
  • Assisting in the determination of what information should be sought in Discovery so that the corporate structure can be obtained to reveal the true position of the family's assets.
  • Conducting an investigation into the financial affairs of the other party.
  • Determining which assets require valuation by other parties - property, actuarial valuations.
  • Preparation of business, share and other equity valuations.
  • Critically appraising business valuations prepared by other parties.
  • Preparing an independent expert's report that summarises the approach to our financial investigation, brings together other valuations (in respect to properties etc), includes business and equity valuations and summaries the net asset pool of the family.
  • Provision of an authoritative expert witness in court during Family Law Court proceedings, in respect to our previously prepared expert reports.
  • Advising on the tax implications of proposed settlements.

We prepare a checklist of the financial, accounting and taxation issues in family law property settlements.
